1. Who we are and acceptance of these Terms

The terms “CineD”, “cinema5D”, “we”, “us” or “our” refer to the owner of this website, cinema5D GmbH, registered office Kranzgasse 22/9-10, 1150 Vienna, Austria, company registration number FN 484301 i. “You” refers to any user or viewer of this website.

By accessing or using this website, including the CineD Databases (defined in Section 4), you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use the website. We may amend these Terms at any time; the version published on this page at the time of your use applies, and continued use following a modification constitutes acceptance of the revised Terms.

2. General use of the website

• The content of this website is for your general information and use only. It is subject to change without notice.
• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
• Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It is your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

3. Intellectual property

• This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, graphics, text, photographs, video content, lab test results, and editorial works published on this website.
• Reproduction, distribution, or communication to the public of this material is prohibited without our prior written consent, except for brief quotations with attribution as permitted by law.
• All trademarks reproduced on this website which are not the property of, or licensed to, the operator are acknowledged on the website.

4. The CineD Databases

4.1 Description. This website contains structured databases created, maintained and verified by cinema5D GmbH, including but not limited to the CineD Camera Database, the CineD Lens Coverage Tool, the CineD Lab Test datasets, and any associated comparison tools and datasets (together, the “CineD Databases” or the “Data”). The Data is the result of original research, testing, measurement, curation, selection, coordination and arrangement by CineD, and is made available exclusively for online viewing and comparison through the website’s interface.

4.2 Database rights. The CineD Databases are the result of substantial investment in the obtaining, verification and presentation of their contents. cinema5D GmbH is the maker of the CineD Databases within the meaning of Directive 96/9/EC and holds the exclusive rights in them under §§ 76c–76e of the Austrian Copyright Act (UrhG) and corresponding provisions of EU law, in addition to any copyright subsisting in their selection and arrangement. All rights are reserved.

4.3 Permitted uses. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

• access and view the Data through the website’s standard user interface for your personal or internal professional reference purposes;
• use the website’s built-in comparison tools to compare camera and lens specifications online;
• share a direct hyperlink to a specific page or comparison within the website, provided the link does not circumvent any access controls;
• reference individual data points in your own original written works (for example reviews, articles or production notes), provided such references are limited in scope, clearly attributed to CineD, and include a link to the relevant Database page.

4.4 Prohibited uses. You must not, without our prior written permission:

• download, save, export or otherwise extract the Data or any substantial part of the CineD Databases to any local device, storage medium or third-party service;
• copy, reproduce, duplicate or create derivative works from the Data or any part of the CineD Databases;
• incorporate contents of the CineD Databases into any third-party website, application, product, dataset or database, whether commercial or non-commercial, and whether or not attribution is provided;
• republish, redistribute, sublicense, sell, rent or otherwise make the Data or any part of the CineD Databases available to any third party;
• extract and/or re-utilize the whole or a substantial part of the contents of the CineD Databases, or repeatedly and systematically extract and/or re-utilize insubstantial parts thereof.

5. Automated access, scraping, and text and data mining

• Automated access to this website (including by crawlers, scrapers, bots or headless browsers) for the purpose of systematically harvesting, copying or extracting content or Data is prohibited, except for standards-compliant indexing by public search engines in accordance with our robots.txt file.
• Reservation of text and data mining rights. Pursuant to Article 4(3) of Directive (EU) 2019/790 and its implementation in Austrian law, cinema5D GmbH expressly reserves all rights in respect of text and data mining of the contents of this website and of the CineD Databases. Text and data mining, including for the purposes of training, fine-tuning, grounding, retrieval augmentation, evaluation or operation of machine learning models or artificial intelligence systems, is prohibited without a prior written license agreement. This reservation is additionally expressed in machine-readable form in our robots.txt file.
• Circumvention of technical measures limiting access, including rate limits and access controls, is prohibited.

6. Licensing

We license Data from the CineD Databases and other content for commercial and non-commercial use — including bulk access for researchers, manufacturers, developers and media — on individually agreed terms covering scope, attribution, and update frequency. Licensing enquiries: office[at]cined.com.

7. Cookies and privacy

Information about the cookies and similar technologies used on this website, and about how we process personal data, is provided in our Privacy Policy and in our consent management tool.

8. Links and affiliate disclosure

• Pages on this website may include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s), and we have no responsibility for the content of the linked website(s).
• Some of these links, especially (but not limited to) those to the websites of our main retail sponsors B&H and CVP, might include affiliate referral codes which allow our retail sponsors to track your purchasing on their sites for the purpose of paying affiliate referral fees to us. We never receive or store any personal data about the buyers in that process.

9. Enforcement

• Unauthorised use of this website, including unauthorised extraction or re-utilization of the CineD Databases, may give rise to claims for injunctive relief and/or damages and/or constitute a criminal offence.
• You acknowledge that unauthorised extraction, reproduction or redistribution of the CineD Databases would cause cinema5D GmbH irreparable harm for which monetary damages alone would be an inadequate remedy, and that cinema5D GmbH is entitled to seek injunctive relief in addition to any other remedies available at law.
• We may suspend or terminate your access to the website or the CineD Databases at any time in the event of a breach of these Terms.

10. Governing law and final provisions

• Your use of this website and any dispute arising out of such use is subject to the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Vienna, Austria. Mandatory consumer protection provisions of the ABGB and KSchG remain unaffected for consumer users.
• Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
